Terms of Service

User Agreement
It is the client’s responsibility to read and accept the ToS before beginning the commission process. By Commissioning me, you have agreed that you have read and accepted all of the terms listed here.
You agree to this policy of using the art for personal, non-profit purposes and provide appropriate image credit.

Commissions

Ordering
-You are expected to fill out the Commission Form located on my website (located under the Commission button).
-Your request will be reviewed and I will contact you to confirm your slot or deny you. I am allowed to decline any request that makes me uncomfortable.
-To guarantee the total accuracy of your request, please note down any required details that you do not want to be left out.
-If your character is extremely detailed, I have the right to charge an additional fee based on these details. This fee will be stated before the transaction and you hold the right to make your own changes to your request (for example: discuss changes to alter pricing and small bargaining) before the transaction is complete.
-I will send you an invoice via Paypal. You need to confirm the payment with me before I start your order.
-Once payment is confirmed, I will start on the commission as soon as I can.
-I will always send a WIP Sketch, Color Base, for your approval.
-Once the sketch/Color Base is approved, I will then finish the commission. I am only able to make very minor edits after this phase.
-If you fail to respond to my message about the WIP within three days, I will go ahead and finish it without approval. Once finished, I will ask you again if anything needs to be changed (only slight color changes and other very minor edits), then I will send you a full-sized image and a smaller-sized image of the completed piece.

Payment
-I can only accept payment through Paypal.
-Commissioners have 48 hours to send payment once the invoice is sent. If payment is not sent within that time, I will message you about it. If something comes up where you are unable to pay within 48 hours, please let me know. Things happen. If you can’t or fail to pay, I will cancel your commission.
-Payments via Paypal are sent via Invoice method only unless otherwise stated. I will cover the Paypal fees as it is expected from the Artist per Paypal ToS. What you see is what you will have to pay.
-Please note that all of my sales are "Digital Artwork" and it is the Artwork’s "Intellectual Property" that is purchased by you, the Client.
-Nothing is ever intended by either me or the Client, to be physically shipped to them.
-I am not required ever to ship any item unless it was explicitly discussed.
-Tips are greatly appreciated, but not necessary by any means! If you want to tip me, there will be an option on the invoice to tip.
-Rush fees can apply if a client needs artwork by a specific date. The fee may vary depending on the project and the time frame provided.

Cancellations/Refunds
-If the commissioner cancels a commission and work has been done on it, I will refund depending on what I haven’t finished. Commissions that have yet to be started will give the commissioner a full refund, then a percentage refund depending on already made progress.
-If I cancel a project, I will refund 100%.
-If we agree on a payment plan and I start the commission after the first deposit has been done, I will not refund your said deposit if you back out of the Payment Plan.Charge Back
-You are NOT authorized to issue a chargeback for any reason. (unless discussed PRIOR to the chargeback)
-If for any reason your PayPal account malfunctions or authorizes a refund request without your knowledge, you must contact me as soon as possible in order to resolve the issue.
-You are required to contact me when you need to cancel a commission request.

Turnaround Times and Delays
-I have a full-time job, Monday - Friday, My set drawing days are Tuesday and Thursday. I will take 2 to 3 business days to review your request and accept or decline.
-I try to complete commissions in the order they are received, providing a concrete turnaround time is difficult based on availability but I aim for a full queue to be complete in two months.
-If there is a deadline that you want me to meet, (for things like birthday gifts, anniversaries, debut covers, etc.) then let me know. Extra fees may apply depending on the timeframe.
-If you did not alert me to a deadline, you must not send reminders. Reminders will be ignored if they relate to work that I have prioritized above your request, including other commissions and gift art.
-If due dates are discussed, it is also the client’s responsibility to ensure prompt communication. I will not be held responsible for late delivery.
-If something happens in my life that will interrupt my commission work, then I will let you know.

Final Product
-There may be slight differences between the samples in my gallery and the illustration you will receive.
-I reserve the right to reject critiques pertaining to artistic skill and stylization, and if the critique reduces the artistic quality of the piece.
-Credit to me is required when you post or use it on another platform.
-You are responsible for saving any information, images, and other digital data I provide. Any file you paid for will be available from me for a finite time only. I take measures to preserve most files for up to 3 months. However, I cannot guarantee against computer failure or accidental deletion, or loss.
-I am not required to post your project in any public space, and if posted, I am not required to keep it there indefinitely. I have the right to delete or remove any public project, even if you paid for it, as you should have your own copy for personal use.
-Feedback on the final product is permitted after completion of the piece, through private messages or comments. Any comments that are rude, inappropriate, inflammatory, and/or non-constructive will be ignored.

__General Terms__

Client Agreement
-You may display my work on external sites as long as visual credit to me is provided
-This work is for personal use only, including but not limited to; avatars, phone or computer wallpapers, and social media (with credit provided).
-You reserve the right to print or create physical copies of said artwork for personal use only (ie. not for sale or redistribution)
-You may not use my artwork for redistribution of external projects, commercial or non-commercial use (ie. t-shirts, mugs, public flyers, albums) unless otherwise discussed with different terms applied/changed.
-You retain all rights to your character
-You may not claim my work as your own
-No modification/changing of the completed piece is allowed nor can it be used in edits
-No tracing is allowed to create a “new” image or “base” from the completed artwork
-Signatures and/or watermarks indicating the artwork is my intellectual property are not allowed to be removed
-If you have commissioned and/or received work before this TOS has gone into effect are still bound to its contents.
-By commissioning my services, you have read and agreed to the ToS on this page. Please read these terms carefullyArtist Agreement

-If you wish to order a commission for commercial use, the total price of the commission as well as any other royalties will be agreed upon upfront
-Price may vary depending on the extent of use, I reserve the right to increase the price if I deem necessary
-All new terms must be discussed and enclosed in a document format for both parties
-This is only an option only when I agree to commercial use, otherwise, commercial use is not an option

Non-Disclosure Agreements (NDAs) - Privacy Request
-If you wish for your request to be private, it must be stated during the ordering process.
-This privacy request states that I am not allowed to share any WIPS on social media, nor am I allowed to stream the process of this commission on any streaming platform.
-In turn, you will not be allowed to share or display this image on your own social media or any other sharing site.
-Set dates for an “image release” can be discussed and an NDA can have a set time frame for a debut.Copyright
-I reserve the right to sign and/or watermark my own work. I will send you a full-resolution image (by email or via google docs), but my signature will remain on both the full-resolution and smaller versions of the Artwork.
-You are responsible for protecting your ownership over rights to a character design made by me by creating a copy image with your name added as well (ie. through a watermark) when uploading on external sites.
-I retain all copyright over my work, which includes the right to redistribute, reproduce, or use the image as a sample for sales or self-promotion unless otherwise agreed upon. In the case of a Public Commission, I may do whatever I wish with the art (eg. post it to other sites such as Instagram) but will give proper credit to you for ownership of the character’s design.
-In the case of a commission, I will not claim the rights to a character design unless it was one of my own designs. Therefore I will not reuse/resell the Artwork for personal or commercial projects unless agreed upon.
-In the case of an adoptable design, I will not reuse/resell the rights to the design once ownership is transferred to you, the client.

Disclaimers
-By purchasing my services(art), you automatically agree to the following conditions.
-If you are not comfortable with my ToS and/or not willing to agree to the conditions, you may not request a commission
-My art is not allowed to be used for AI purposes. Please do not upload the artwork to any site that may utilize this method of “creating” art.
-I do not support the use of NFT. Do not use or provide my art for NFT usage on any site/email request
-I will never draw child-like characters in any kind of suggestive/lewd way. Never ask.
